It will soon be easier for you to get VA health care in your community without paperwork.

In or after January 2020, you won’t have to provide a signed, written authorization for VA to release your electronic VA health information to a participating community care provider.

VA will automatically begin sharing your health information with participating community care providers using the Veterans Health Information Exchange. The electronic system is secure and safe.

This change will make it easier for your health care team to make better decisions about your health care. It can also help you be safer, especially during emergencies.

No action needed

If you are OK with VA sharing your electronic patient information with your community care provider, you don’t have to do a thing. Your information will be shared automatically.

Form needed to OPT OUT of electronic sharing

However, if you do not want to share your information electronically, you must submit VA Form 10-10164 (Opt Out of Sharing).

THERE IS NO SEPT. 30 DEADLINE TO SUBMIT YOUR FORM 10-10164.

You can submit your Form 10-10164 at any time. VA will share your information until you submit your form.

If you submitted Form 10-0484 before September 30, you do NOT need to submit Form 10-10164.

You can return VA Form 10-10164 at any VA Medical Center. Just visit the Release of Information (ROI) office. You can also send it by mail. After VA processes your form, your VA health information will not be shared electronically with community providers you see for treatment.

Change your mind? No problem

You change your mind and share your health record with your participating community provider. Just complete and return VA Form 10-10163 (Opt In for Sharing) at any time.

You also can still ask VA to share your information with participating community care providers by fax or mail service.

Veterans living abroad

If you are a Veteran living and/or receiving care abroad, you don’t have to do anything. VA only shares health information with participating community care providers who treat you in the United States. If you plan on receiving care in the U.S. from VA and/or a participating community care provider, then you need to opt out by submitting VA Form 10-10164 if you do not want to share your health information.

If you don’t share your information, it will not affect your VA health care or your relationship with your VA health care provider.

    Please be cautious: This kind of HIPAA breaching PII-share has been tried at least 3 times before (in the last 15 years), and each has been cancelled only after the security incompetence has become undeniable. Twice it has been obvious enough that registration required all participants (me) to accept an EULA which expressly required me to give the third-party communications service provider HIPAA-protection-compromising access to all information passed on the service.
    Once any PII is released to a third-party (not legally bound by HIPAA), the loss of HIPAA protection for that data is permanent. So far, the worst effect on me (that I know of) has been the advertising pipeline to sometimes dozens of spam calls daily, that seems to begin a few weeks after I pick up a prescription, often referring explicitly to the medication or equipment I received from the dispensary, and the insurance opportunities I should buy.
    It might someday be possible for the military (or even civilian providers) to implement such a VPN service if both client & provider ends of the VPN is secure & (end-to-end) encrypted. Although the form implies the ” “Virtual Lifetime Electronic Record (VLER)-VA”, 168VA10P2″ is secure, they have failed to indicate that they have thought about this communication issue, much less tried to meet even this minimum standard of care for our PII. Yet ‘their process release’ also has the hubris to presume that we shouldn’t protect our sensitive and potentially harmful PII & medical information that we each have a right and even duty to protect.
    I hope this critique is effective & constructive.

    Every Tom, Dick and Harry in the US and abroad knows everything about me. Since the SS number has been given out to everyone, and to spit it out loud when you check in for VA appointments, my privacy has been compromised. There is no privacy anymore, especially in the VA system. Thanks VA for all the bull you have created. Six (6) shoulder operations, four at the VA in Lebanon, then they realized they did not know what they were doing thanks to the surgeon in Orthopedics, they send me to Milton Hershey.to try and correct their mistakes.

    Umm, I hate to tell you this, but HIPAA only requires that you be ALLOWED to ask for restriction of your records. It specifically says that they don’t have to AGREE to it!! (45 CFR §164.522(a)(i).
    And not only that, NO hospital in the country will agree to, either!
    (I’m GUESSING that this is out of fear of losing out on the billions in Incentive Payments HHS hands out to medical entities for switching to electronic records. Something they probably would have done anyway!)

    And this is in spite of the fact that 50% of all identity theft has its origins in the healthcare system.

    Fortunately, our VA records are also protected by the Federal Privacy Act. (Title 5)

    BUT, with VA’s switch to the Cerner Health Information Exchange, they are probably going to want to do the “right thing” and share our VA records with the world.
    But they are at least continuing to allow us to opt out.
    And, NO, they can’t just do that arbitrarily. HIPAA also sez that once an entity agrees to a restriction, they can’t revoke it without notifying us, and then it only applies to records going forward. I was told that letters will be going out to all of us who restricted release on form 10-0484.

    However! It came to my attention that outside providers can now see that I have a record at VA on the Epic Health Information Exchange! And probably YOU too!
    They can’t ACCESS our VA records however.
    I’m assuming that this is to let outsiders know the records exist, in case of an emergency.
    But I still don’t like that.
    And I guess VA doesn’t care.

    FYI ALL…
    I was DoD and VA medical 24 years.
    THIS IS MORE than just medical continuity of care!!!
    1) 2002, DoD medical records combined with the VA troops leaving the service needing care or benefits.
    2) 2004, the VA started sharing back with DoD on Vets.
    3) but…kept separate computer systems.
    However!!!!
    4) DURING THE PUSH FOR NATIONAL HEALTHCARE THIS HAPPENED AND WE WERE NEVER INFORMED.:
    May 11, 2012, the Federal Register states President Obama directed the VA to create a national data base. The VA posted for 30 days in this book for public comments and afterwards approved their plan.
    When…you actually read it starting out, it sounds like improvements…
    BUT THEN…
    a) It states…this NEW NATIONAL DATA BASE WITH HAVE ACTIVE DUTY, GUARD, RESERVE, VETERANS, CIVILIAN DEPENDENTS, CIVILIAN CONTRACTORS, SUBCONTRACTORS…ETC.
    b) THAT THEY DO NOT HAVE TO ASK ANYONE’S PERMISSION TO RELEASE MEDICAL AND OR PERSONAL INFO.
    c) They CAN release to:
    Foreign agencies
    EEO
    Labor unions
    IRS
    Licensure boards
    DOJ
    Congress
    Media if they feel embarrassed
    Research
    Commanders
    Retaining boards
    Federal, state, local, profit, nonprofit
    AND…THEY KEPT SAYING…words like to their partners, stakeholders, etc etc etc
    Etc
    Etc
    Etc
    5) IF YOU LOOK AT THAT LAST LINE ON THAT OPT OUT FORM…WHERE IT SAYS VIRTUAL ELECTRONIC LIFETIME DATA AND SEE VA AND SOME NUMBERS, copy, and paste that in google…it goes back to this 2012 federal Register!
    My kids never consented to be in this VA/DOD data base for Vets to transfer for care.
    THIS INFORMATION IS NOT IN THAT 8 PAGE VA MAIL OUT NOR IS IT ON ANY OF THEIR POSTS, EMAILS OR ADS…THE REST OF THE STORY.

    7) THEN, in searching just WHO AND HOW WAS THIS “NATIONAL DATA BASE (WITH LOTS OF CIVILIANS TOO NOW) is…it is at Austin TX and there are some regional sites too.
    20…YES 20, FEDERAL AGENCIES help build this data base.
    Now…why in the hell would 20 federal agencies need to be in my medical records?? Or yours or your families?
    8) I know very well…being psst medical, I can do a release to anyone I need to for care. I do NOT NEED THIS SCARE TACTICS IF YOU DON’T OPT IN, YOU CAN’T GET CARE OR HELP IN AN ER OR WHATEVER…
    SO…THIS BLANKET POLICY SERVES NO PURPOSE OTHER THAN TO CYA THEIR ASS THAT FOR THE 2013 SITES RUNNING HAS BEEN IN YOUR RECORDS ALREADY FOR THE PAST 6 YEARS WITHOUT TELLING YOU OR ME.
    9) A LAWSUIT HAS ALREADY BEEN FILED TO STOP THIS BLANKET…WE CAN DO WHATEVER, WHENEVER WE WANT WITHOUT YOUR KNOWLEDGE OR PERMISSION NOW POLICY…IT IS UNCONSTITUTIONAL.

    This IT online medical records data base is REALLY BIG BUSINESS…millions, upon millions of dollars, and the gov health dept in DC is the center of it all and is out of control with this do whatever they want now.
    The original idea to save money from paper, to coordinate your agreed care was great things but…in reading…the past and current template designs…shareholders, other, doesn’t work for me.

    Sadly, to read this all happened under the table, never told, never consented 6+ years ago is just UnAmerican and does not follow our nations nation’s foundation on our knowledge and rights.

    So who in the current VA administration made this decision to remove Vets from the HIPPA laws intended to protect American citizen’s privacy? So Vets will now automatically become second class citizens without their consent, unless they go through a process to assure they are treated as well as other citizens. Something stinks about this whole process. To remove Vets from a law intended to protect their rights to privacy and the control of their data should require an act of congress. I’ve heard nothing about congress acting to abrogate our (specifically Vets) rights. HIPPA already allows you to give access to any provider you wish to share your data with, the choice should not be up to the VA to share your data with ANYONE they want, unless you say otherwise. This should be an OPT-IN, not an OPT-OUT situation.
    It should also be obvious that once your data is shared outside of the VA system, whoever has it then must be trusted to keep it to themselves. Wow, that’s a pretty broad statement of trust on the part of Vets who won’t even know who their data is being shared with. Vets should demand to be informed anytime their data is shared and to know with whom it is shared, and only after the Vet gives specific consent as to what data and to whom.

    At least this gives us an option to opt-out, as long as it works. I’ve personally seen opt-out information shared anyway, and blamed on oops. As a responsible veteran, you should already have your own copy of your medical record/history, and given this to your PCP. The VA certainly could have abused the current system, and used similar tactics of Equifax and Capital One by selling our data to the highest bidder, and calling it a data breach. No accountability, nor investigation as to whom would benefit most from the data breach. Conspiracy theory or not, it’s still a theory, and I’m constantly welcoming facts to dispell my thoughts.

    I’m glad to see veterans caring about this issue. The fact is HIPPA is clear that medical information belongs to the patient and, with limited exceptions involving patient safety, can only be shared with our written consent- even when provided voluntarily, those data cannot be shared without consent. According to HHS.gov: “The [HIPPA Privacy] Rule also gives patients rights over their health information, including rights to examine and obtain a copy of their health records, and to request corrections.” This is per 45 CFR 164.502(a).
    As a lot of vets point out, what we’re not seeing mentioned here is how are data are shared. That an important point. The eHealth Exchange, the org that would be sharing our VA health info, is managed by The Sequoia Project. As disabledveterans.org points out, there are vendors on Sequoia’s Board of Directors including Hans Buitendijk from Cerner and Brian Ahier from Mitre Corporation. Mitre is a civilian research think tank. They want our data, one of the most valuable data sets in existence, to perform research, again, without your consent. Cerner, on the other hand, works with the RAND Corporation- another think tank with ties to the New America Foundation and Google- the largest data compiling company to ever exist. You know who isn’t on the Board? Anyone from the VA. They “liaison” with the VA instead. We’re to expect those who share our data won’t share it with themselves? They manage our data out of their commitment to civic duty?

    Retain your rights. Opt out. You can still share your own data with whomever you choose.

    Does anyone qualified* to answer this question know: will the sharing of VA records with the DoD for medical reasons and with base commanders for fitness for duty determinations be retroactive to records that existed prior to Sep 30th privacy practice changes? Also, will Vet Center mental health treatment records be included with with the information disclosed to DoD? I work with veterans who are still serving in Guard, Reserve, and Active components who want to know.

    OHHH JIMBO!! Why do you want the FBI, DHS, etc. to have access to your medical records? Don’t they already have as uninhibited access to most of your records as it is?! Why not give them the last little bit of privacy you have for added ease of your tragically difficult life, right?? Chances are you have never heard of George Orwell, or 1984. Pick up a book and educate yourself.

    DO NOT SHARE my medical records.
    VAs iterative EHR requests are insulting, disruptive and annoying intrusions upon the personal sovereignty of honorable veterans everywhere.

    I have considered this thoughtfully, have NOT changed my mind and NEVER expect to do so.

Any digital information that resides on any type of computer that is connected to the internet is secure only until it isn’t.

    There is a lot missing here:
    1. What do I need to do to allow the community doctor to access VA records? (I am guessing most doctors don’t have a facial recognition system tied to the VA so I must need to do or provide something.)

    2. What does the doctor need to do? (Not all community doctors are part of the VA and may not be familiar with VA procedures, so I may need to explain it to them.)

    3. What do they get? (I have trouble figuring out what they are saying and I was there. My primary care couldn’t figure out what dosage cardiology was prescribing with calling cardiology. VA medical records tend to range from cryptic to useless but extremely voluminous and hard to find anything.)

    “Opt-in” is the process used to describe when a positive action is required in order to subscribe a user to a newsletter list, for example.
    “Opt-out” on the other hand means that a user can be signed up much more easily and he needs to be given the possibility to opt-out easily.
    Under opt-in regimes, the second “Opt-out” process would be forbidden. Usually opt-out is used as a term for the regime that is being applied for US-American direct marketing messages, while opt-in is the regime that is used under European and Canadian data protection rules.
    The data protection agency of the UK explains opt-in boxes in this way:
    Opt-in boxes are boxes where a tick indicates that the person agrees to receiving the specified marketing. Best practice is to provide an unticked opt-in box, and invite the person to confirm their agreement by ticking. This is the safest way of demonstrating consent, as it requires a positive choice by the individual to give clear and explicit consent.

    Personally, I don’t want my VA medical records to automatically be disseminated to any and every organization without my permission! I turned my forms in on the 30th. I specifically asked who my records would be shared with. Her response was, “Well, right now just the major medical providers such as Group Health, Fransician Health Care, Blue Cross, etc.” RIGHT NOW??? Um……NO! I see where this is going!

    The Dept of Veterans Affairs is one of the largest health care systems in the country. The private sector wants access to us. No. NO!! Not without my permission will they get ANYTHING from me!

    This is great news. In 2009 I had mri, Rhuematologist told me I needed spinal fusion surgery. At that time it took forever to see a surgeon, even epidural injection was 4 months out and that was just a meet and greet, no injection. I found a Dr outside VA, he asked me to bring a disc of the MRI with me on my visit. Went to get one, the tech on duty told me it would cost five dollars at that time to get one, or he could have one mailed to the Dr. I gave him the Dr address before I left, gave him date of my appt a week away. Well come appt time, disc wasn’t there not even typed report. The surgeon went and called and he got what he needed right then and there. Now I can go on line and print my records off, but some labs and xrays etc are hard to print off as they are not in my records. Why. If I need to take records with me it is easy to just go in plug in the dates I need and print them off.

    In 2017, I filled out a VA Form so my personal community-based physician could access my electronic health records. Unfortunately, that was it !!!

    No further information was available for my doctor or I to get (her) access to my electronic health records. Where was the breakdown?

    All ‘in All, my situation is (probably) different than those you write about; but, sir/ma’am, please help us overseas U.S. Veterans to get more quality healthcare and “electronic health records” information-highway open for our community-based Doctors.

    My (permanent) home is the Republic of the Philippines Islands.

    We live on the largest of the ten largest islands (Luzon); while the Republic of the Philippines is made up of 7,641 islands only 2,000 are inhabited. Manila, the capital of the Philippines, is where our VAMC (Veterans Administration Medical Center) is located. It originated out of the necessity for the U.S. to have a place to care for our Filipino War Veterans. We, as American veterans are permitted to get our (very limited) medical care and our medications there.

    Without going into a full-blown dissertation of the “whys” and “wherefores” for reasoning and the fact that it took the U.S. 50 years to provide for our Filipino war vets – it’s clear to me – something is lacking.

    Please give us (Filipino and American) war veterans some of the same care and attention our U.S. based veterans are getting. Some things just need to be simplified and added and considered so we may (all vets here) have a more fulfilling quality of life.

    Please understand, while the Manila VAMC was built for our Filipino war vets I am honored to have the privilege to go there and get my VA health care. One- Hundred- percent- (100%) service-connected- disabled- veteran does Not carry the same meaning here (or care required) that it does in the United States. Yes, I made a conscience decision to move here and would appreciate your understanding “I am Not complaining” about the level of healthcare I and my fellow veterans receive. I’m only asking for more. Understand we are the Only VA Healthcare Facility outside of the United States; but, we all served in the same wars and armed conflicts.

    We have a well-managed and passionate Manila VAMC Philippines; however, they can use a lot more support. We need the VAMC here, so please keep it open and favorably consider stocking it with more Formularies, Doctors, and Nurses.

    The Prosthetics Department was already shut down causing stress on veterans who used it and those who are eligible to use it – in the future.

    Yes, we were told to buy our CPAPs, accessories, assisted walking paraphernalia on the local economy; then, file a claim with FMP (Foreign Military Program) for reimbursement – come on – STRESSOR. Also, if we order any of those same parts or equipment from outside the Philippines, we do Not get reimbursed. WHY?!! Why the added out-of-pocket expense?

    Lastly, thank you for clearing the way for (our veterans) Doctors pain free access to (my) our electronic health records, or those whose want it. The breakdown has been repaired, I hope!

    NOW, Please tell Veterans – overseas – how to help their attending-community-based-Physicians to get access to our electronic health records.

    I don’t want my information shared because I have parasites since 2013 and my first trip to the doctor the resident I saw wrote in my records that I was parasitic delusional just like she had the microscope with special lights to spot them on her eyeballs. My primary care doctor agreed with her and several months went by and the infection I had in my right eye had spread from the top of my head to my toes. Every doctor I saw after that agreed with her also because that is the VA policy in Indianapolis they like keeping people sick especially with parasites so they will get sicker like develop cancer or Crohn’s disease. You know that parasites in the US is epidemic the doctors at Ivy League schools state that eighty to ninety precent in the USA have them and don’t know it. I don’t want my quack doctors passing on their opinions to my new doctor outside of the VA. The bad thing is that all of Europe was alarm when the North Korean Soldier defected and he was full of parasites and here I am a Honorably Discharged Vietnam Soldier and my doctors say I am parasitic delusional even though I sent off a specimen to the Parasitology Laboratory in Scottsdale Arizona. The said that I have plus three round worm in my urine. I still have them and they are a resistive strain because taking Abendazole for three consecutive month did not kill them plus I had a few doses of Ivermectin and that did not kill them. The doctors at the Indianapolis VA are all quacks and are keeping people ill. Do yourself a favor and get this book written by Dr Gordon and it is called “Forbidden Cures”. This book is really good and it talks about how to get healthy from Alzheimer’s, Cancer, and many serious health conditions and backs all of that by research.

    I know first hand that getting medical records from the VA can be a daunting task. Hopefully this will help provide better continuity of care for veterans who see providers inside and outside of the VA.

      I know it’s frustrating when some doctors don’t know about a particular area of medicine–but act like you’re crazy if you do. If you are dealing with mites in your eyes, there is a way to get rid of them using a blend of tea tree oil with another base oil. I don’t recall the exact percentages recommended. I think I found info on that on NIH research site. My memory says it might have been a research study by a doctor in Thailand. Probably can find with some Internet searching. This doctor resolved the matter by treating eyes with tea tree solution once a week for 6 months.

      Along with treating your eyes, you must treat your house. Wash all your towels and bedding including pillows. Then if you hire an exterminater they will use use something like Precor 2000+ to spray the entire house & you should get rid of problem. I wouldn’t try using bug sprays from the discount stores. If you do it yourself at least get some protective things for breathing & eye protection.

    So why are we , the Veteran allowed direct access to the C&P Exam results when the exam is done by the outside contractor?? I was told by VES that VA instructed them to in NO WAY allow the Veteran access to the C%P Exam report, WHY?? By whom?? This contactor needs to be investigated by the IG to see how well its complying with its contract, sa there admin services are very poor and all they are doing is contributing to the C&P Exam backlog, not improving it, that contractor needs replacing by one that will do its job and not just take the money!!!!

    Why is the VA releasing veteran medical records to the DHS FBI ? Veterans are being targeted for gang stalking by the criminal entities. The VA is facilitating veteran suicide. The liberal and rogue resist movement members control these agencies in California and are provoking veterans to commit suicide by gang stalking veterans .The Resist Movement and the DHS FBI and VA are one in the same, punishing conservatives and veterans for their support of Trump. These people are criminal for violating civil liberties and civil rights of veterans. It is time for POTUS to get involved and to prosecute these people for human trafficking. I have made my case and I have received a resounding yes, the White House is on it.

        Still living in a bubble, we see! I guess you have never seen the April 2009 BORN OF TREASON “dept. of homeland security” report on Rightwing Extremism, and what it has to say about Vets being Disgruntled, and possible Lone Wolf Terrorists, etc.?
        The St. Louis VA Medical Center sent the BORN OF TREASON “dept. of homeland security” to my home back in 2011 just because I threatened to release legally requested VA Records online that prove it was committing crimes, etc. against me/other Veterans!
        Just a reminder, if you are a Vet- You swore a Never-Ending Oath to the US Republic/Constitution, NOT to the “us government”!

      You need to READ the information AGAIN or have someone explain it to you.You shouldn’t post online personal information. In YOUR situation you WANT your information shared so you don’t need to do anything this information doesn’t effect you then. HOWEVER you can’t decide who you want your information to be shared with. The ONLY way you can do that is to OPT OUT and then as you want information to be given to.your other Dr’s you would then need to request that portion of your medical records and sign the release for that to happen..
